This Data Deletion Policy explains how LocalMark.AI handles requests to delete account data, business profile data, free scan data, audit data, reports, PDF files, task data, marketing post data, support messages, usage records, and related service records. LocalMark.AI is operated by BRILHORDEIRO - UNIPESSOAL LDA, doing business as LocalMark.AI, if applicable. The operator is established in PORTUGAL, with mailing address RUA DO VISCONDE DE ANADIA 11A, FUNCHAL, MADEIRA PORTGUAL.
LocalMark.AI is intended only for businesses located in the United States and authorized representatives of those United States businesses. LocalMark.AI is not intended for EU, EEA, UK, or non-US customers, consumers, or businesses through this site. Customer account, business, audit, report, billing, support, and operational data is intended to be stored and processed using United States-based infrastructure and service providers where practical. Because the operator is established in PORTUGAL, this policy must be reviewed for both United States customer-facing requirements and Portugal/EU operator requirements.
Deletion requests may be submitted by the account owner, an authorized account administrator, or another person who can reasonably verify authority over the relevant account or business data. We may require identity, account, email, billing, or business verification before processing a deletion request. We may deny or delay requests when we cannot verify authority or when retention is required or permitted by law, billing, security, fraud prevention, dispute resolution, or operational needs.
To request deletion, contact LocalMark.AI through the contact form, at [email protected]. Include the account email, business name, website URL, the specific data you want deleted, and whether you are requesting deletion of a single business, a report, a free scan, or the entire account. We may ask for additional information to verify the request and confirm the scope.
Account deletion may remove or disable access to the customer dashboard, business profiles, audit history, reports, PDFs, monthly progress tracking, marketing posts, tasks, notifications, and related product records. Account deletion does not automatically delete records we must retain for billing, tax, accounting, legal, security, fraud-prevention, dispute, backup, or operational reasons. We aim to review and process account deletion requests within 30 days after verifying the request, unless more time is needed because of legal, billing, security, fraud-prevention, backup, or operational requirements.
Business profile deletion may remove or archive the selected business profile, locations, phone numbers, service/category details, Google listing selections, competitor selections, audit runs, report links, task links, marketing post records, and related product history for that business. Deleting a business may make prior reports, PDFs, tasks, marketing posts, and progress history unavailable. We aim to process approved business-level deletion requests within 30 days after verifying the request, unless more time is needed because of legal, billing, security, fraud-prevention, backup, dispute, or operational requirements.
Free scan records may include business name, website URL, email address, homepage scan data, preview score, findings, location information, Google listing candidates, IP address, user agent, status, timestamps, and related product events. Free scans that do not convert to paid accounts are intended to be retained for 90 days and then deleted or anonymized, unless retention is required or permitted for security, abuse prevention, legal, or operational reasons.
Paid audit records may include business profile data, website crawl evidence, Google Places evidence, competitor snapshots, audit steps, findings, scores, AI-generated report sections, PDF report files, task workspaces, monthly progress data, marketing post batches, downloads, usage records, and related provider usage. Paid reports and related history are intended to be retained while the account is active and for 2 years after account closure unless deleted earlier by request or retained longer for legal, billing, dispute, security, fraud-prevention, or operational reasons.
PDF reports and other generated files may be stored in private file storage. If a deletion request is approved, we may delete or disable access to related PDF files and file records. Some file references, logs, download records, checksums, or backup copies may remain temporarily or longer where required or permitted for billing, security, legal, fraud-prevention, backup, or operational purposes.
Marketing post records may include generated captions, hashtags, suggested photos, calls to action, platform labels, status values such as draft, planned, posted, or skipped, timestamps, and links to the source report or business. Deleting a business, report, or account may remove related marketing post records. You are responsible for deleting or editing any content you already copied, exported, published, emailed, posted, or saved outside LocalMark.AI.
Task records and monthly progress records may include task titles, descriptions, priorities, status changes, completion dates, skipped reasons, evidence summaries, report links, and related activity history. Deleting reports, businesses, or accounts may remove or disable access to these records, subject to retention exceptions.
Support records may include your name, email address, selected support topic, message, account status, signed-in user email when available, IP address, user agent, timestamps, internal notes, and related diagnostic information. Support records are intended to be retained for 3 years to respond to requests, resolve disputes, investigate issues, improve the service, and maintain business records unless deletion is required or permitted earlier.
Billing and subscription records may include plan, subscription status, billing period, cancellation status, Stripe customer ID, Stripe subscription ID, payment status, invoices or receipts available through the payment processor, checkout events, account ownership records, and related billing metadata. Billing records are intended to be retained for 7 years or longer where required for tax, accounting, payment, chargeback, legal, fraud-prevention, or compliance reasons.
Payments are processed by third-party payment providers such as Stripe. Deleting LocalMark.AI account data does not automatically delete information held by Stripe or other payment processors. Payment processors may retain data according to their own legal obligations, fraud-prevention needs, tax obligations, financial rules, and privacy policies. You may need to contact the payment processor directly for certain payment-related privacy requests.
We may retain security events, rate-limit events, login records, password reset records, email verification records, IP addresses, user agents, product events, usage events, queue/job records, admin actions, logs, and diagnostic records for 12 months or longer where needed to protect the service, investigate abuse, prevent fraud, comply with law, resolve disputes, or maintain platform reliability.
Deleted information may remain in encrypted or access-controlled backups for a limited period until backups expire, are overwritten, or are deleted according to backup schedules. Backup data is not intended to be restored except for disaster recovery, security, legal, or operational needs. Backups are intended to be retained for 30 to 90 days.
We may retain information when required or permitted for legal obligations, tax obligations, accounting records, billing records, payment disputes, chargebacks, fraud prevention, security investigations, abuse prevention, Terms of Service enforcement, Acceptable Use Policy enforcement, legal claims, audit history, backups, system integrity, or other legitimate business and operational reasons. Retained information may be limited, archived, anonymized, or restricted where practical.
If you copied, downloaded, exported, emailed, posted, published, shared, or otherwise used LocalMark.AI outputs outside the platform, we may not be able to delete those external copies. This includes PDFs downloaded to your device, marketing posts published to social platforms, website copy added to your website, emails sent to customers, or information stored by third-party providers.
Instead of deleting certain records, we may anonymize, aggregate, or de-identify information so it is no longer reasonably linked to an identifiable account, user, or business. We may use anonymized or aggregated information for analytics, product improvement, cost tracking, service reliability, security, and business planning.
Deleting account, business, report, or billing-related data may permanently remove access to reports, PDFs, task history, marketing posts, monthly progress history, audit evidence, subscription features, and account settings. Some deletion requests may require canceling an active subscription first or may prevent LocalMark.AI from continuing to provide service.
If you request deletion while a subscription is active, we may ask you to cancel the subscription first or confirm that deletion will remove access to paid features. Deletion of account data does not automatically cancel payment obligations unless cancellation is completed through the billing tools or payment processor, subject to applicable law and the Refund Policy.
We aim to review deletion requests within 30 days, but timing may vary depending on verification, request scope, legal obligations, billing status, backup schedules, provider systems, and support volume. We may confirm completion, deny the request, partially fulfill the request, ask for clarification, or explain why certain records must be retained.
Depending on where you are located and which laws apply, you may have rights to access, correct, delete, export, restrict, or object to certain processing of personal information. LocalMark.AI is intended for United States businesses and not EU, EEA, UK, or non-US customers, but the operator is established in PORTUGAL, so legal counsel should confirm applicable Portugal/EU and United States privacy request requirements.
Deletion may not be immediate across all systems. Some records may take time to remove from active systems, backups, logs, indexes, caches, analytics systems, provider systems, email systems, file storage, or payment processor systems. We will use reasonable efforts to process approved deletion requests according to this policy, applicable law, and operational requirements.
This Data Deletion Policy should be read together with the Terms of Service, Privacy Policy, Refund Policy, Acceptable Use Policy, AI Disclaimer, No-Guarantee Marketing Disclaimer, and any checkout or plan terms presented to you. If there is a conflict, the wording that gives the customer non-waivable rights required by applicable law will control.
We may update this Data Deletion Policy from time to time. If required by law, we will provide notice or obtain consent before certain changes take effect. Continued use of LocalMark.AI after an updated policy is posted, presented, or accepted means you acknowledge the updated policy, unless applicable law requires a different process.
