This Acceptable Use Policy explains what customers may and may not do when using LocalMark.AI. LocalMark.AI is operated by BRILHORDEIRO - UNIPESSOAL LDA, doing business as LocalMark.AI, if applicable. The operator is established in PORTUGAL, with mailing address RUA DO VISCONDE DE ANADIA 11A, FUNCHAL, MADEIRA PORTGUAL. This policy is part of the Terms of Service.
LocalMark.AI is intended only for businesses located in the United States and authorized representatives of those United States businesses. LocalMark.AI is not intended for EU, EEA, UK, or non-US customers, consumers, or businesses through this site. You may not create an account, start a subscription, request scans, generate reports, or use LocalMark.AI for a non-US business unless we expressly approve that use in writing and all required legal review is completed.
You may use LocalMark.AI only for businesses you own, manage, represent, or are otherwise authorized to review. You may not submit a business, website, Google listing, competitor list, phone number, address, or other business information if you do not have the right to use it for LocalMark.AI reports, audits, marketing drafts, or related services.
You must use LocalMark.AI in compliance with all applicable United States federal laws, state laws, local laws, advertising rules, consumer protection rules, privacy rules, marketing communication rules, industry rules, licensing requirements, and professional requirements that apply to your business. The operator may also be subject to Portugal/EU business, privacy, tax, accounting, and online-service obligations because the service is operated from PORTUGAL.
You may not knowingly submit false, misleading, incomplete, outdated, unauthorized, or deceptive information. This includes business names, service categories, services offered, locations, service areas, phone numbers, websites, Google listing selections, competitor selections, claims, certifications, awards, prices, offers, reviews, testimonials, or other information used by LocalMark.AI.
You may not use LocalMark.AI outputs to create, support, publish, or distribute unlawful, deceptive, unfair, misleading, or unsubstantiated marketing. This includes false claims, fake reviews, fake testimonials, misleading prices, misleading offers, unsupported guarantees, false emergency claims, false licensing claims, fake local presence, impersonation, hidden fees, bait-and-switch claims, or claims that require proof you do not have.
You may not represent LocalMark.AI reports, scores, findings, tasks, or marketing post drafts as guarantees of rankings, traffic, leads, phone calls, appointments, sales, revenue, reviews, ratings, Google visibility, AI answer visibility, or business outcomes. Any marketing content you publish must be reviewed and approved by you before use.
AI-generated content from LocalMark.AI is draft content only. You are responsible for reviewing, editing, approving, fact-checking, and legally validating any AI-generated report text, task, recommendation, caption, hashtag, review request, FAQ answer, service description, or website copy before publishing, sending, relying on, or acting on it.
You may not use LocalMark.AI to create, request, encourage, hide, manipulate, buy, sell, or publish fake reviews, misleading testimonials, undisclosed endorsements, review gating, review suppression, deceptive review requests, or any reputation practice that violates applicable law, platform rules, or customer trust standards.
You may not use LocalMark.AI for illegal products or services, scams, deceptive businesses, counterfeit goods, stolen goods, malware, unlawful surveillance, exploitative services, hate or harassment, adult sexual services, illegal drugs, unauthorized gambling, unlicensed financial services, unlicensed legal services, unlicensed medical or health services, weapons or restricted goods, or other high-risk or restricted categories.
If your business operates in a regulated industry, you are solely responsible for ensuring that your use of LocalMark.AI and any content generated from it complies with licensing, advertising, disclosure, professional, and industry-specific rules. This may include industries such as healthcare, legal services, financial services, insurance, real estate, home services, education, transportation, alcohol, tobacco, cannabis, firearms, security, and other regulated categories.
You may not use LocalMark.AI to harm, threaten, harass, defame, impersonate, exploit, discriminate against, or abuse any person, business, customer, competitor, employee, contractor, platform, provider, or third party. You may not use LocalMark.AI to publish hateful, violent, abusive, sexually exploitative, discriminatory, or otherwise harmful content.
You may not attempt to bypass authentication, access another account, probe or scan systems without authorization, exploit vulnerabilities, introduce malware, interfere with service operation, disrupt queues or workers, attack infrastructure, overload the platform, scrape protected content, abuse APIs, or attempt to access data you are not authorized to access.
You may not reverse engineer, decompile, copy, clone, resell, frame, scrape, bulk extract, benchmark for competitive purposes, or create a competing product from LocalMark.AI unless expressly permitted in writing. You may not use automated tools to create accounts, submit scans, generate reports, exhaust plan limits, bypass billing, avoid rate limits, or abuse free scan features.
You may not use LocalMark.AI to collect, process, upload, or expose personal information, business information, customer information, employee information, competitor information, or third-party data in a way that violates privacy laws, platform rules, contractual obligations, or third-party rights. You are responsible for having any required permissions, notices, consents, or legal bases for information you provide.
You may not submit or use content that infringes or misappropriates copyrights, trademarks, trade secrets, publicity rights, privacy rights, contractual rights, database rights, or other rights of any person or business. You are responsible for ensuring that business names, logos, text, photos, website content, marketing claims, and submitted information are authorized for your use.
LocalMark.AI may help compare public competitor information when available. You may not use competitor-related features to harass, defame, impersonate, mislead, scrape unlawfully, interfere with, or harm competitors. Competitor comparisons are informational and must not be presented as proof of wrongdoing, legal conclusions, or guaranteed market position.
If you use LocalMark.AI outputs on Google Business Profile, Facebook, Instagram, your website, email, SMS, or another platform, you are responsible for following that platform’s rules, terms, advertising requirements, review policies, content restrictions, and disclosure requirements. LocalMark.AI does not guarantee that any generated content is acceptable for a third-party platform.
You may not use LocalMark.AI content for spam, unlawful email, unlawful SMS, robocalls, unsolicited messages, deceptive review requests, or direct marketing that violates applicable law. You are responsible for obtaining any required consent, honoring opt-outs, including required disclosures, and following email, SMS, telemarketing, and platform rules.
You may not use false billing information, stolen payment methods, unauthorized payment methods, chargeback abuse, subscription manipulation, coupon abuse, account cycling, fake identities, or any other payment-related misuse. We may suspend access and provide relevant records to payment processors or authorities when required or appropriate.
You must follow plan limits, usage limits, crawl limits, generation limits, rate limits, and fair-use controls. We may block, throttle, delay, reject, or review requests that appear abusive, automated, excessive, high risk, or harmful to platform reliability, provider costs, other customers, or service availability.
You may not abuse, threaten, harass, spam, deceive, impersonate, or submit malicious content to LocalMark.AI support, administrators, staff, contractors, or service providers. We may refuse support, restrict contact, suspend accounts, or terminate access for abusive or unsafe conduct.
To report suspected misuse, unauthorized activity, prohibited content, security concerns, or policy violations, contact us through the contact form or at [email protected]. Include relevant account details, business names, URLs, screenshots, report names, timestamps, and a short explanation where possible.
We may review account activity, product events, security events, usage records, support messages, billing status, report activity, generated content, and technical logs to operate the service, investigate suspected misuse, enforce this policy, protect customers, comply with law, prevent abuse, and maintain platform reliability.
If we believe this policy has been violated, we may warn you, remove content, reject scans, block generation, limit access, suspend an account, terminate access, cancel a subscription, refuse refunds where permitted, preserve evidence, contact payment processors, notify affected parties, or report activity to authorities where required or appropriate.
If you believe an enforcement action was taken in error, you may contact support at [email protected] with your account email, business name, action taken, and explanation. We may review appeals at our discretion, but we are not required to restore access where we believe continued use creates legal, security, payment, provider, or operational risk.
We may update this Acceptable Use Policy from time to time. If required by law, we will provide notice or obtain consent before certain changes take effect. Continued use of LocalMark.AI after an updated policy is posted, presented, or accepted means you agree to the updated policy, unless applicable law requires a different process.
