This Privacy Policy explains how LocalMark.AI collects, uses, stores, shares, and protects information when you use our website, free scan, account dashboard, audits, reports, PDF downloads, monthly progress tracking, marketing post tools, billing features, support form, and related services. LocalMark.AI is operated by BRILHORDEIRO - UNIPESSOAL LDA, doing business as LocalMark.AI, if applicable. The operator is established in PORTUGAL, with mailing address RUA DO VISCONDE DE ANADIA 11A, FUNCHAL, MADEIRA PORTGUAL and tax/VAT registration 518132960.
LocalMark.AI is intended only for businesses located in the United States and authorized representatives of those United States businesses. LocalMark.AI is not intended for EU, EEA, UK, or non-US customers, consumers, or businesses through this site. Customer account, business, audit, report, billing, support, and operational data is intended to be stored and processed using United States-based infrastructure and service providers. Even though the service is intended for United States business customers and data is intended to be stored in the United States, the operator is established in PORTUGAL, so this Privacy Policy must be reviewed for both United States customer-facing requirements and Portugal/EU operator requirements.
We may collect information you provide directly, including name, email address, password credentials or authentication information, business name, website URL, business category, services, location type, address or service area information, ZIP code, phone number, Google business listing selections, competitor selections, support messages, contact form submissions, billing-related information, notification preferences, account settings, and any other information you choose to submit.
We may collect and store business profile details, structured location and phone data, website URLs, crawl results, homepage evidence, page titles, meta descriptions, detected contact signals, detected service and location signals, Google Places information when available, competitor snapshots, audit findings, scores, report sections, PDF report records, monthly progress data, 30-day task data, and marketing post drafts generated from report evidence.
We may collect and store account membership information, organization or workspace information, subscription status, plan, billing period, cancellation status, usage balance, usage limits, checkout events, Stripe customer identifiers, Stripe subscription identifiers, payment status, and related billing metadata. Payment card numbers and sensitive payment credentials are handled by our payment processor and are not intended to be stored directly by LocalMark.AI.
When you contact support, we may collect your name, email address, selected support topic, message, account status, signed-in user email when available, IP address, user agent, timestamps, and related diagnostic information. We use this information to respond to your request, troubleshoot issues, prevent abuse, improve the service, and maintain support records.
We may collect technical and usage information such as IP address, user agent, browser type, device information, pages visited, timestamps, log data, rate-limit events, security events, product events, report views, PDF downloads, task status changes, marketing post status changes, checkout attempts, provider usage, API usage, queue/job status, errors, and other diagnostic or operational records.
We may use cookies, session storage, local storage, server-side sessions, analytics tools, security tools, or similar technologies to keep you signed in, protect accounts, remember preferences, operate the service, understand product usage, prevent abuse, and improve performance. LocalMark AI may use cookies, server-side sessions, local storage, and similar technologies that are necessary to operate the service, keep users signed in, protect accounts, remember basic preferences, prevent abuse, and maintain security. We do not currently use advertising pixels, retargeting cookies, or third-party behavioral advertising cookies unless stated here or in a cookie notice. If we later add analytics, advertising, retargeting, session recording, or similar tracking tools, we will update this policy and provide any required notices, choices, or opt-out tools before or when those tools are used.
We use information to provide free scans, create and manage accounts, verify email addresses, process login and password reset requests, run audits, crawl submitted websites, match Google business listing evidence when available, discover competitors, generate findings and scores, create dashboard reports and PDF reports, create 30-day task lists, create marketing post drafts, track monthly progress, provide support, send service emails, manage subscriptions, prevent abuse, secure the platform, troubleshoot issues, monitor usage, control costs, and improve LocalMark.AI.
LocalMark.AI may send structured audit evidence, business profile details, website evidence, competitor context, findings, scores, and related report context to AI providers to generate plain-English explanations, report sections, task plans, and marketing post drafts. AI is used to explain and draft from available evidence, not to independently verify all business facts. You are responsible for reviewing AI-generated content before using, publishing, or relying on it.
We may use third-party service providers for hosting, database storage, file storage, payment processing, email delivery, Google Places data, AI report generation, analytics, monitoring, security, DNS, content delivery, and operational tooling. Current or expected providers may include AWS, Stripe, Resend, Google Places, OpenAI, Cloudflare, and other providers needed to operate the service. Customer account, business, audit, report, billing, support, and operational data is intended to be stored and processed on United States-based systems where practical.
When you search for or confirm a Google business listing, we may request and store public Google Places information such as business name, address, phone number, website, place ID, category/type, rating, review count, status, and related match data when available. We may also store competitor place IDs, competitor names, competitor addresses, competitor websites, ratings, review counts, and snapshots when available. Google-related data may be incomplete, delayed, unavailable, or subject to Google terms.
When you submit a website for a free scan or paid audit, we may access publicly available pages, collect limited page evidence, store URLs, status codes, final URLs, page text signals, metadata, contact signals, service signals, location signals, and related crawl results. We may limit crawl depth, skip pages, stop processing, or fail gracefully when websites block access, time out, return errors, or create unreasonable technical burden.
We may send transactional emails and in-app notifications related to email verification, password resets, free scan results, report readiness, PDF readiness, billing, subscription status, account security, support requests, task reminders, audit issues, and important product updates. You may have settings for certain optional notifications, but some service, billing, security, and legal notices may still be required.
We may share information with service providers that help us operate LocalMark.AI, process payments, send emails, store files, host infrastructure, generate AI content, monitor systems, prevent abuse, provide support, comply with law, or enforce our policies. We may also share information if required by law, court order, legal process, government request, security investigation, business transfer, merger, acquisition, financing, sale of assets, or to protect rights, safety, and security.
Payments are processed by third-party payment providers such as Stripe. Stripe may collect and process payment method details, billing details, transaction information, fraud prevention signals, tax information, and other payment-related data according to its own terms and privacy policy. LocalMark.AI may receive and store limited payment-related identifiers and subscription status information needed to manage access.
LocalMark.AI is designed so customer account, business, audit, report, billing, support, and operational data is stored and processed using United States-based infrastructure and service providers where practical. Servers, database systems, storage systems, queues, logs, and production service data are intended to be located in the United States.
We retain information as needed to provide the service, keep account and report history, maintain audit evidence, support billing records, comply with legal and tax obligations, resolve disputes, prevent abuse, secure the platform, troubleshoot issues, and operate the business.
You may request deletion of certain account or business data through support or available in-app tools. Some information may be retained where required or permitted for legal, tax, billing, accounting, security, fraud prevention, dispute resolution, backup, or operational reasons. Deletion may remove access to reports, PDFs, business profiles, audit history, tasks, marketing posts, and related account data. Deletion requests are also subject to our Data Deletion Policy.
We use reasonable technical and organizational measures intended to protect information, such as access controls, authentication, rate limiting, security logging, provider security controls, and limited administrative access. No online service can guarantee complete security. You are responsible for using a strong password, keeping login credentials confidential, and notifying us promptly if you believe your account has been compromised.
LocalMark.AI is intended for United States business customers and production data is intended to be stored and processed using United States-based infrastructure. The operator is established in PORTUGAL, and service providers may be based in or access data from the United States or other locations as needed to operate, support, secure, or maintain the service.
Depending on where you are located and which laws apply, you may have rights to access, correct, delete, export, restrict, or object to certain processing of personal information. Because LocalMark.AI is intended for United States businesses and not EU/EEA/UK customers, rights may vary by applicable law and customer status. You may contact us at [email protected] to make a privacy request.
Some United States state privacy laws may provide rights to residents or businesses depending on thresholds, customer status, data type, and business activity. LocalMark.AI must be reviewed for whether laws such as California privacy laws or other state privacy laws apply.
Because the operator is established in PORTUGAL, Portugal/EU privacy, business identity, tax, recordkeeping, electronic commerce, and data protection obligations may apply even though the service is intended only for United States business customers and production data is intended to be stored in the United States.
LocalMark.AI is not intended for children or for personal, household, or consumer use by minors. You may not use LocalMark.AI if you are under the age required to enter into a binding agreement in your jurisdiction. We do not knowingly collect information from children.
If LocalMark.AI or its assets are involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, information may be transferred or disclosed as part of that transaction, subject to applicable law and any required notice.
Some browsers may send Do Not Track signals. Unless required by law, LocalMark.AI may not respond to Do Not Track signals in a standardized way.
We may update this Privacy Policy from time to time. If required by law, we will provide notice or obtain consent before certain changes take effect. Continued use of LocalMark.AI after an updated Privacy Policy is posted, presented, or accepted means you acknowledge the updated policy, unless applicable law requires a different process.
You may contact LocalMark.AI about privacy questions or requests through the contact form, at [email protected]. Legal or privacy notices should be sent to BRILHORDEIRO - UNIPESSOAL LDA, RUA DO VISCONDE DO ANADIA 11A, FUNCHAL, MADEIRA PORTGUAL, unless a different notice method is required by law.
